With this issue we initiate the policy of expanding the scope of Tulane Studies in Philosophy to include, in addition to the work of members of the department, contributions from philosophers who have earned advanced degrees from Tulane and who are now teaching in other colleges and universities. The Editor THE LOGIC OF OUR LANGUAGE ROBERT L. ARRINGTON Wittgenstein wrote in the Tractatus that "logic is not a body of doctrine, but a mirror-image of the world. " 1 In (...) line with his suggestion that a proposition is a 'picture', Wittgenstein argued that propositions 'show' the logical structure of the real. He was insistent, however, that "the apparent logical form of a proposition need not be its real one. " 2 As a result of this we can misunderstand the structure of fact. Philosophical problems arise just when "the logic of our language is mis understood. " 3 It is common knowledge that much of this view of logic was rejected by Wittgenstein himself in the Philosophical Investi gations. There we are told that language has no ideal or sublime 4 logic which mirrors the structure of the extra-linguistic world. Consequently, inferences from the structure of language to the structure of that extra-linguistic world are invalid. Reality can be 'cut up' in any of a number of ways by language. Wittgenstein adopted a view of philosophy which would render that discipline a non-explanatory, non-critical study of the multiple ways in which language can be used. (shrink)

Perhaps no other population exposes the clinician to more moral and legal dilemmas than clients with an HIV-positive diagnosis. What does the therapist do about the HIV positive patient who is having sex with unnamed partners and refuses to stop? What should be said in end-of-life decisions? What of the adolescent who is HIV positive but whose guardian does not wish the youth to be informed of his status?

In three experiments we studied lay observers’ attributions of responsibility for an antisocial act (homicide). We systematically varied both the degree to which the action was coerced by external circumstances and the degree to which the actor endorsed and accepted ownership of the act, a psychological state that philosophers have termed ‘identification’. Our findings with respect to identification were highly consistent. The more an actor was identified with an action, the more likely observers were to assign responsibility to the actor, (...) even when the action was performed under constraints so powerful that no other behavioral option was available. Our findings indicate that social cognition involving assignment of responsibility for an action is a more complex process than previous research has indicated. It would appear that laypersons’ judgments of moral responsibility may, in some circumstances, accord with philosophical views in which freedom and determinism are regarded to be compatible. Recent policy debates in the US over access to mental health care have raised several philosophically complex ethical and conceptual issues. The defeat of mental health parity legislation in the US Congress has brought new urgency and relevance to theoretical and empirical investigations into the nature of mental illness and its relation to other forms of sickness and disability. Manifold, nebulous, and often competing conceptions of mental illness make the creation of coherent public policy exceedingly difficult. Referencing a variety of (...) approaches to ethical reflection on health care, and drawing from the empirical literature on therapeutic efficacy and economic efficiency, we argue that differential rationing, ‘disparity,’ is unjustifiable. In his dozens of books and lectures he wrote about the qualities of art. the key figure, the history that connected one to another. In The Stones of Venice, Modern Painters, Seven Lamps of Architecture he developed rules and standards that are amazingly contemporary in their range of sympathies. However, Ruskin wrote thousands of pages of criticism; for the modern reader his thought needs always to be rediscovered. This anthology (...) by Robert Herbert contains the essential thought of Ruskin on theory and practice (creativity, color, compositio, exhibiting workd of art), ("the nature of gothic," Venetian Renaissance, iron and glass as new materials for building), and sculpture and ornament (Greek, Byzantine, Medieval, and Renaissance). Herbert devotes his section on painting to Ruskin's remarks on Giotto, Fra Angelico, Botticelli, Michelangelo, the Venetians, Turner, the Pre-Raphaelites, and many others. Ruskin was full of contradictions and quirks, but he is the one 19th-century critic who gave the 20th century many of its most progressive thoughts on architecture, painting, and relationship of art to a social and moral context."--BOOK COVER. Cautioning in advance that summary treatment of any aspect of Dewey's thought, much less one as far-reaching in compass as his ethics, must of necessity be omissive, I shall in the following develop what I believe to be the most plausible rendering of his ethical philosophy. In so doing I will confine myself principally to explicating his stand vis-à-vis contemporary metaethical positions, though I will expand upon this in the later sections and introduce some of his normative, or substantive, views (...) as well. In the final section I will outline a theory of morality as a whole which, though nowhere explicitly defended by Dewey, is consonant with the various theses he does defend. The burden of my argument, however, will be to show, first, that he is not holding the sort of position usually characterized as ethical naturalism, and secondly, that the position he does hold marks a significant departure from all three of the conventional metaethical positions, intuitionism, naturalism, and noncognitivism. Metaphorically he stands at the third point of a triangle, the other two points of which are naturalism and emotivism, for he adapts salient features of each of these positions to an orientation which fits the framework of his view of the nature of ethics, science and philosophy in general. Let us begin by assessing the chief arguments in support of a naturalistic interpretation, as these will provide a point of departure for clarifying his considered view. (shrink)

A problem of paramount importance to understanding John Dewey’s ethics is to clarify his conception of judgment and his distinction between judgments and propositions. Depending upon how one interprets him on this matter, different answers suggest themselves to some of the most basic questions underlying his ethical theory, particularly those dealing with the relationship between science and ethics, the relationship between practical judgments and descriptive statements, and the differentiae of moral and scientific judgments within the genus practical judgment. Oversimplified (...) answers are usually given to these, the stock interpretation being that he believes that ethics is reducible to science, that practical judgments are descriptive and hence that moral judgments are essentially scientific in nature. Although he undeniably says much to invite such an interpretation, it nonetheless fails to do justice to his considered view, and a probe of his account of the nature of judgments and propositions reveals that he views the whole relationship of moral to scientific judgments, hence of ethics to science, in a different light than is generally supposed. In consequence, much of his ethics needs reappraisal, particularly as having relevance to topics in the forefront of contemporary British and American ethical thought. (shrink)

In the last two decades, several important steps have been made by Catholics, Protestants and Orthodox Christians to engage in meaningful dialogue with members of the Islamic faith.1 While sincerity, (...) mutual respect and good will are all in evidence in these efforts to dialogue, it also is clear that an authentic theological discussion between Christians and Muslims cannot help but arouse a certain degree of tension over the Christian doctrine of the Incarnation. In my own experience in dialogue with Muslims,2 there seems to emerge a point in which discussion of Jesus the prophet vs. Jesus the Incarnate Word of God will inevitably take place. Such discussions can prove to be stimulating and educational. FASTIGGI the two traditions. As Georges Anawati, a Catholic Islamicist; notes : " As a starting point, dialogue requires respect for the identity of the other. It does not ignore obvious differences... for to do so would be of no use for ·either friendship or truth." 3 A Muslim scholar, Professor Mohammed Taibi of the University of Tunis, likewise remarks that " the more one is firm about the classical aspects of divergence, the better the contacts between Christians and Muslims." 4 At issue in the Christian-Muslim discussion of the Incarnation is the unique character of each faith. In Islam, there is the absolute affirmation of divine unity (tawhid) which necessarily condemns any attempt to associate something other than God with God (shirk). Christianity, though, has as one of its central tenets the affirmation that the uncreated Word of God (ho logos) became flesh (sarx) in Jesus (John 1 :14). Islam, therefore, presents a unique challenge to the Christian theologian. Is it possible to formulate a Christology which can affirm the Islamic principle of tawhid and evade the accusation of shirk without compromising the core of the Christian message? This is the question this article hopes to address. One suggestion for Christians in dialogue with Muslims is given by Hans Kiing in his book Christianity and the World Religions.5 Kiing believes that Christians would do best to go back to the mindset of the original Jewish Christians who possessed an understanding of Jesus which is much more compatible with the Qur'anic view of Jesus as the "servant of God." 6 While Kiing's suggestion is helpful for Christians who are looking for an analogy to the Islamic view of Jesus, I find it problematical for several reasons. The best-known controversy in film criticism of recent years has been over the authorship of the Citizen Kane script. Pauline Kael first raised the issue in a flamboyant piece in The New Yorker in 1971. Contrary to what Orson Welles would like us to believe, Kael charged, the script for the film was actually not his work but almost wholly the work of an all-but-forgotten figure, one of Hollywood's veteran screenwriters, Herman J. Mankiewicz. . . . The first two drafts (...) of the Citizen Kane script were written by Herman Mankiewicz and John Houseman in seclusion in the desert at Victorville, California, during March, April, and May 1940. Officially, Houseman was there as an editor. But part of his job was to ride herd on Mankiewicz, whose drinking habits were legendary and whose screenwriting credentials unfortunately did not include a reputation for seeing things through. Detailed accounts of the Victorville interlude have been given by Houseman in his autobiography and by Kael in "Raising Kane." There was constant interchange between Victorville and Hollywood, with Houseman going in to confer on the script and Welles sending up emissaries and regularly receiving copies of the work in progress. Welles in turn was working over the draft pages with the assistance of his own secretary, Katherine Trosper, and handing the revised screenplay copy in its rough state over to Amalia Kent, a script supervisor at RKO noted for her skills at breaking this kind of material down into script continuity form, who was readying it for the stenographic and various production departments.1 · 1. The threat of atomic destruction has heightened the criminal irresponsibility of aggression, the employment of war as an instrument of national or bloc policy. Correspondingly, the moral obligation to discourage such a crime or, if it occurs, to deny it victory, has been underscored. The consequences of a successful defense are fearful to contemplate, but the consequences of a successful aggression, with tyrannical monopoly of the weapons of mass destruction, are calculated to be worse. While the avoidance of excessive and (...) indiscriminate violence, and of such destruction as would undermine the basis for future peace, remain moral imperatives in a just war, it does not seem possible to draw a line in advance, beyond which it would be better to yield than to resist. Though he has worked almost exclusively in collaborative mediums like radio and film, Orson Welles has always tended to think of himself as an individual author. "Any production in any medium is a one-man production," he said to me. On the question of sharing creative responsibility for the works that bear his name, he is deeply ambivalent. His insistence on multiple billings for himself is legendary. As I can well testify, the very mention of the term collaboration at a wrong (...) moment can be enough to send him into a rage. The controversy over who scripted Citizen Kane initiated by Pauline Kael hurt him very deeply. That the wound still festers to this day is evident in the rancor with which he speaks of former associates like John Houseman. Yet in quieter moments he will fully concede how indispensable his principal collaborators have been to him and will openly discuss the nature and extent of their contributions. He is especially full of praise for cinematographers with whom he has worked over the years, such as Gregg Toland, Russell Metty, and, more recently, Gary Graver. On Citizen Kane, he singles out four individuals whom he thinks deserve special recognition: writer Herman Mankiewicz, art director Perry Ferguson, composer Bernard Herrmann, and Toland. Of these, he says, Toland's contribution to the film was the greatest, second in importance only to his own. In this essay I deal with the history and nature of Welles' collaboration with Toland on Citizen Kane—what brought them together, their working relationship, and the characteristics and rationale of the visual plan they created for the film. As we shall see, Toland brought a largely pre-conceived visual plan to Citizen Kanewhich he had been working out in his previous films. Welles accepted Toland's plan so readily because he recognized how dramatically appropriate it was to the story material. Toland's cinematography for Citizen Kane also left a major legacy to Hollywood films of the 1940s.Robert L. Recent scholarship has inquired into the socio-historical, discursive genesis of trauma. Trauma and the Ontology of the Modern Subject, however, seeks what has not been actualized in trauma studies - that is, how the necessity and unassailable intensity of trauma is fastened to its historical emergence. We must ask not only what trauma means for the individual person's biography, but also what it means to be the historical subject of trauma. In other words, how does being human in this current (...) period of history implicate one's lived possibilities that are threatened, and perhaps framed, through trauma? Foucauldian sensibilities inform a critical and structural analysis that is hermeneutically grounded. Drawing on the history of ideas and on Lacan's work in particular, John L. Roberts argues that what we mean by trauma has developed over time, and that it is intimately tied with an ontology of the subject; that is to say, what it is to be, and means to be human. He argues that modern subjectivity - as articulated by Heidegger, Levinas, and Lacan - is structurally traumatic, founded in its finitude as self-withdrawal in time, its temporal self-absence becoming the very conditions for agency, truth and knowledge. The book also argues that this fractured temporal horizon - as an effect of an interrupting Otherness or alterity - is obscured through the discourses and technologies of the psy-disciplines (psychiatry, psychology, and psychotherapy). Consideration is given to social, political, and economic consequences of this concealment. Trauma and the Ontology of the Modern Subject will be of enduring interest to psychoanalysts and psychotherapists as well as scholars of philosophy and cultural studies. (shrink)

The aim of UK-REACH (“The United Kingdom Research study into Ethnicity And COVID-19 outcomes in Healthcare workers”) is to understand if, how, and why healthcare workers (HCWs) in the United Kingdom (UK) from ethnic minority groups are at increased risk of poor outcomes from COVID-19. In this article, we present findings from the ethical and legal stream of the study, which undertook qualitative research seeking to understand and address legal, ethical, and social acceptability issues around data protection, privacy, and information (...) governance associated with the linkage of HCWs’ registration data and healthcare data. We interviewed 22 key opinion leaders in healthcare and health research from across the UK in two-to-one semi-structured interviews. Transcripts were coded using qualitative thematic analysis. Participants told us that a significant aspect of Big Data research in public health is varying drivers of mistrust—of the research itself, research staff and funders, and broader concerns of mistrust within participant communities, particularly in the context of COVID-19 and those situated in more marginalised community settings. However, despite the challenges, participants also identified ways in which legally compliant and ethically informed approaches to research can be crafted to mitigate or overcome mistrust and establish greater confidence in Big Data public health research. Overall, our research indicates that a “Big Data Ethics by Design” approach to research in this area can help assure (1) that meaningful community and participant engagement is taking place and that extant challenges are addressed, and (2) that any new challenges or hitherto unknown unknowns can be rapidly and properly considered to ensure potential (but material) harms are identified and minimised where necessary. Our findings indicate such an approach, in turn, will help drive better scientific breakthroughs that translate into medical innovations and effective public health interventions, which benefit the publics studied, including those who are often marginalised in research.
